Various US State Law / With reference to Massachusetts Regulations 105 CMR 630.000 & New York Codes, Rules and Regulations (NYCRR) Title 10, § 12.12 & Rhode Island General Laws, Title 11, § 11-9-16 & California Business and Profession Code § 22200 & Code of Virginia, § 18.2-320

Plastic bags with a thickness of less than 1 mil (0.001 inch) having an opened end larger than 5 inches in diameter shall contain the following warning statement or equivalent:

 

WARNING: To avoid danger of suffocation, keep this plastic bag away from babies and children. Do not use this bag in cribs, beds, carriages or playpens. This bag is not a toy. 

 

The warning shall be printed clearly so as to prevent the ink from smearing, or upon a gummed label securely attached to the plastic bag, and in a prominent place with legible bold face type which shall be contrasted by typography, layout or color from the contents of the bag and from other printed matter on the bag, if any.

 

The size of the print shall be as follows. If the total length and width of the bag is more than 40 inches, the warning shall be repeated at intervals of 20-inches or less.

NOTE: The requirement for bags intended for freshly clean clothes is per state of Virginia.

The Lacey Act prohibits the import of certain plant or plant products without an import declaration. The declaration must contain, among other things:

 

- scientific name of the plant,

- value of the importation,

- quantity of the plant,

- name of the country from where the plant was harvested, and

- paper and paperboard products containing recycled content must also contain average percent of recycled content without regard for species or country of harvest.
